Asked Questions

A trade mark is a sign that distinguishes the goods and services of one trader from those of others. It can be words such as names, indications, designs, letters, characters, numerals, figurative elements or any combination thereof. 

Registering your trade mark protects your brand and gives you the legal right to prevent someone from taking advantage of your goodwill by using similar or same trade marks. By registering your trade mark, you are entitled to take legal action against those who use or copy your brand without your permission. Additionally, a registered trade mark can be a valuable intangible asset to your business which you can sell or license.

Your application must indicate one or more ‘classes’ and include the types of goods and/or services in the classes that you want to register your trade mark with. The goods and services are classified into 45 different classes based on the Nice Classification.

Registering your trade mark under a specific class prevents someone from registering the same or similar trade mark in the same class. In general, the trade mark office will conduct a deficiency check and then a search on the trade mark registry for any identical or similar trade marks which have been previously applied for or registered by someone in the same or similar classes of goods and services. If the office does not raise any objections during this examination, your application will proceed to publication for any third party to oppose the application within a fixed period. If no one opposes after the publication period, your trade mark will be registered.
